Washington State’s attorney general has warned that publicly financed programs that provide clean needles to drug addicts in Seattle and Tacoma are illegal. But local health officials said the programs would continue.The programs are intended to control the spread of AIDS by removing contaminated needles from circulation. The officials said the exchanges of needles had attracted some addicts to treatment centers.The Attorney General, Ken Eikenberry, issued his opinion Wednesday as Dr. Louis W. Sullivan, the United States Secretary of Health and Human Services, told Congress that the Bush Administration opposes them. He had backed exchanges.
Mr. Eikenberry, acting in response to a state lawmaker’s request, said that Washington State’s 1988 AIDS law did not authorize needle exchanges and that the Legislature had not amended a 1989 anti-drug law to allow distribution. He said the programs violated laws on distribution drug paraphernalia. Up to Local Prosecutors, He Says
He said local prosecutors should decide whether to bring charges against needle distributors. Prosecutors in both cities said they did not plan to. ‘’These people are not trying to commit criminal acts,’’ said Tom Felnagle, chief criminal deputy prosecutor for Pierce County.
Al Allen, director of the Tacoma-Pierce County Health Department, said, ‘’It’s a narrow construction of the law,’’ adding, ‘’We plan to continue operating our program unless the policy of our health board changes.’’
The needle exchanges were begun in August 1988 by David Purchase, a drug counselor. ‘’We’re going to keep doing what we do,’’ Mr. Purchase said in an interview. ‘’Our goal is to save lives. The seriousness of the problem justifies an appropriate effort to prevent the spread of AIDS.’’

Instead of the old “either/or” paradigm that used a linear, goal based framework, we have a “both/and” paradigm that challenges the clinician and treatment team to work closely together, recognizing the interconnectedness that occurs among untreated trauma, addiction interaction and relapse patterns which are so common for our clients.
